Description
When the parents of a child do not live together, child custody arrangements are necessitated. It is the right to make important decisions about the care and upbringing of the child. Some of those important decisions include schooling, religion, and medical treatment. Custody normally also includes the physical care and control of the child. The child will usually live with the parent who has custody.
There are different types of Child Custody, including sole custody, joint custody, and interim or temporary custody.
Sole custody:~ In situations where one parent has sole custody, the other parent normally has access to the child. The child will live the majority of the time with the custodial parent. The parent with sole custody has the right to make all major decisions about raising the child/children unless a court order or agreement states otherwise.
Joint custody:~ Parents who share joint custody both have the right to make major decisions about the child. The child's physical control (i.e., where the child lives) may be with one parent the majority of the time or the child may live with each parent for equal amounts of time.
Temporary custody:~ If parents cannot resolve their custody and access issues, they may end up in court. Sometimes the court process can take a long time. In such a case, the courts will grant a temporary court order for interim custody until the court hears the full case and decides all of the issues. Since the courts consider stability to be a major benefit to a child, the parent with interim custody most often is granted an order for permanent custody when the judge makes the final court order.
